Warranty Safety Policy

The following Limited Warranty (“Warranty”) is provided by Femto Technologies Inc (“Company” “we,” “us,” or “our”) to the original purchaser (“you” or “Customer”) of the Sensera device, including its authorized accessories, electrodes, charging components provided at the time of sale (collectively, the “Device”). This Warranty is incorporated by reference into, and forms a part of, the Device’s labeling, instructions for use (“IFU”), and any terms and conditions applicable to the sale and use of the Device.

We encourage you to review this Warranty thoroughly to understand the terms and conditions under which your Device is covered. Should you have any questions or require assistance, customer support can provide support and guidance. Please note that by using the Device you are agreeing to be bound by the terms of this Warranty. For any warranty issues, please contact our customer service team at support@senserawellness.com

 

(I)                  ONE (1) YEAR LIMITED WARRANTY

THIS LIMITED WARRANTY GRANTS YOU SPECIFIC LEGAL RIGHTS, WHICH MAY VARY DEPENDING ON YOUR STATE, COUNTRY, OR TERRITORY. OTHER THAN AS PERMITTED BY LAW, SENSERA DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE UNDER APPLICABLE LAWS.

Sensera warrants that the Device will materially conform to its specifications as provided to you in writing at time of purchase, and that it will be free from material defects in materials and workmanship for a period of one (1) year from the purchase date (“Warranty Period”).

This warranty excludes damage resulting from mishandling of the Device or use inconsistent with the Terms of Use , including but not limited water damage, dropping the device, or other acts of negligence. Further please note, this warranty does not cover: (i) consumable parts such as batteries unless failure is due to a defect in materials or workmanship; (ii) cosmetic damage such as scratches unless caused by a defect; (iii) Device has been subject to an accident, misuse, abuse improper maintenance or repair, unauthorized modification, or any other use in combination with any electrode, cable, software, or ancillary product not supplied or approved in writing by the Company; (iv) damage from accidents, abuse, misuse, external causes like fire; or (v) damage caused when using the Device not in compliance with the IFU.

 

(II)                HOW TO INITIATE A WARRANTY CLAIM?

To exercise the Warranty, you must first contact the support team at: support@senserawellness.com with a description of the warranty event, your name, phone number, email, order number, receipt, device serial number, and proof of purchase. Upon written confirmation that the Device is covered under this Warranty, you must ship the defective or damaged Device as instructed. Please be advised that return shipping and any related fees are the responsibility of the customer, however, the shipping costs to send out any applicable replacement or repaired device will be covered by us. 

Company, at its sole discretion, will decide whether to repair the device using new or previously used parts that meet Company’s quality standards or replace the device with a new or refurbished device of the same model or, with your consent, a device with substantially similar features. Devices must be returned in their original packaging or in packaging providing an equivalent degree of protection.

It is your responsibility to back up any data, software, stored on the Device or related to the use of the Device, through the designated app. Depending on where you live, the time it may take such repair or replacement Device to reach you may vary. The repaired or replacement device will continue to be covered for the remaining term of the original one (1) year warranty.

 

(III)              LIMITATION OF LIABILITY

EXCEPT AS EXPRESSLY PROVIDED IN THIS WARRANTY AND SAFETY POLICY AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENSERA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR SAFETY CONDITION OR UNDER ANY OTHER LEGAL THEORY. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF USE, REVENUE, PROFITS, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE.

SOME STATES, COUNTRIES, OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

 

(IV)             GENERAL TERMS

No reseller, agent, or employee is authorized to modify, extend, or add to this Warranty. If any term is held to be illegal or unenforceable, the legality of the remaining terms shall not be affected.

The Warranty shall be governed by and construed in accordance with the laws of the country where the Device purchase took place and shall be further subject to the terms and conditions set forth in the Terms of Use, as updated from time to time.
